- In Florida, you are able live-watch the daily auctions and create immediate surplus records in most of the counties. You cannot do that in other states because most of them have long redemption periods to where a property owner can come back months or 2 years after an auction and redeem their property (by paying the past due auctions). Therefore, if you create a surplus list on the same day as the auction, you never know if or when an owner will redeem and then there would be no surplus.
- Florida’s redemption law is this: the high bidder has 24 hours after the auction to pay their high bid but the property owner can pay their late taxes at any time before that happens. Once the 24 hours is reached or the high bidder pays (whichever comes first), the owner can no longer redeem their property.
- Florida has one of the most open public records law of any state. You are able to dig in and gain access to all documents you need to have all information possible for each surplus record.
- In Florida, you do NOT need to be a lawyer in order to assist others in claiming the surplus.
- There are no maximum caps on the percentage you (as an Asset Recovery Specialist) can charge your client. We find that most start at 40% to give themselves bargaining room.

California: In order to provide good records, we need to obtain the property owners name and hopefully mailing address to help you get a jump start on skip tracking (locating) them. ALL California Counties have a law to where their Property Appraisers cannot post Owner Information online.
Texas: Here is an excerpt from the laws about surplus recovery of foreclosed property auctions (both Mortgage and Tax Deed)
“A fee charged by an attorney to obtain excess proceeds for an owner may not be greater than 25 percent of the amount obtained or $1,000, whichever is less.
A person who is not an attorney may not charge a fee to obtain excess proceeds for an owner.”
